1. DSL DEVICE ELIGIBILITY, COVERAGES AND TERM
This Plan covers qualified DSL devices loaned by StratoNet, Inc. for use in the United States. In order to be eligible for the Service Shield, referred to as the Plan, you (the customer) must have a StratoNet, Inc. DSL account. This Plan covers all mechanical and electrical defects that would normally be covered by the original manufacturer's written warranty, as well as, damage from lightning, unless otherwise stated in the Exclusions section.
Coverage under this Plan shall commence immediately upon activation of the DSL service from StratoNet, Inc. This Plan will furnish a replacement device necessary to maintain your covered DSL device in good operating condition as specified in the terms of this Plan. If service is needed because of a DSL device failure during normal usage, StratoNet, Inc. has the option to repair or replace the defective DSL device with a DSL device of equal or similar features and functionality. A replacement device may be new or reconditioned of like kind and quality. Technological advances may result in a replacement product with a lower selling price than the original product.
The plan covers a maximum of two (2) DSL device replacements or repairs per contract year. The Plan must be kept entire service time. If for any reason the Plan is cancelled, or you use all the allotted replacements, you will be billed in the amount of 100% of the purchase price of any DSL device replaced or repair conducted, less the cost of any monthly premiums made.
If your DSL device needs repair for mechanical or electrical defects, you are required to call 1-888-537-7693 to obtain authorization. For faster service, please have your E-mail address available when you place the call. Please note that the Plan is currently available to U.S. residents only. If you are uncertain whether your device is malfunctioning and require technical support, call 1-888-537-7693.
* StratoNet, Inc. has the option to repair or replace the defective DSL device with one of equal or similar features and functionality.
* Replacement DSL Device may be new or reconditioned.
* StratoNet, Inc. is not responsible for DSL devices or parts received without service authorization.
* In the United States, StratoNet, Inc. may ship a replacement DSL device or part prior to receiving the original DSL device or part("advance exchange"). Advance Exchange requires billing you, the customer, for the replacement DSL Device, and crediting the charge back to your credit card upon receipt of the faulty DSL device. If advance exchange is not available, then the repaired DSL device or part will be shipped as soon as reasonably possible, which will be no later than 5 days after StratoNet, Inc. receives the original DSL device or part.
* When an advance exchange is provided and customer fails to return the original DSL device or part to StratoNet, Inc. within 10 days from the date the replacement is received, The customer will forfeit any charged monies.
* If your DSL device is covered under another valid service contract and/or insurance policy, this Plan will provide coverage over and above the other service contract and/or insurance policy.
* A standard $9.95 Shipping and Handling fee will be charged for all DSL device replacements.
This Plan is not a warranty or insurance policy; it is deemed a service contract under federal law. In no event shall the Administrator be liable for any damages as a result of the unavailability of repair parts. This Plan is an agreement between StratoNet, Inc., P.O. Box 1881, Sebring, FL 33870, and you, the purchaser. Customers having questions regarding the receipt of services under this Plan should call the Administrator at 1-888-382-8503. This document sets forth the entire Plan and may not be modified except by StratoNet, Inc.
This Plan does not cover: any loss or damage resulting from pre-existing conditions (means a condition that within all reasonable mechanical probability relates to the mechanical fitness of your covered merchandise prior to contract issuance); improper installation of components or peripherals; unauthorized repairs or modifications; improper use of electrical/power supply; loss of power; dropped DSL device; collision with another object; any result of a malfunction or damage of an operating part from failure to provide manufacturer's recommended maintenance; transportation damage; damage to cabinetry; attachments; theft, abuse, misuse, neglect, vandalism, or environmental conditions (fire, floods, corrosion, sand, dirt, windstorm, hail, earthquake, or exposure to weather conditions); software and software related problems; incidental or consequential losses; losses on any component(s) never covered by a manufacturer's warranty; reception and transmission problems resulting from external causes.
Other exclusions include but are not limited to: any repair covered by a manufacturer's warranty; recall or rework, regardless of the manufacturer's ability to pay for such repairs; damage resulting from computer viruses; burned-in phosphor in CRTs; products; DSL devices with removed or altered serial numbers; batteries; removal and reinstallation of an internal component not performed by a factory authorized service center; cosmetic or structural items; cables, cords, and connectors; component(s) never covered by a manufacturer's warranty; damage, warping or rusting of any kind in the housing, case or frame of the DSL device or any non-operating part, including plastic or decorative parts; loss of data or for loss of use during the period the DSL device is at a repair facility or otherwise awaiting parts.
If your DSL device experiences a defect or damage that is excluded from coverage under this section or in the event that no covered defect or damage is found, then you are responsible for all repair costs and the cost of on-site service.
Under no circumstances shall StratoNet, Inc. be liable for indirect, consequential, or incidental damages (including damages for lost profits, business interruption, loss of data, and the like), even if any party has been advised of the possibility of such damages. This Plan will not cover any defects that are subject to a manufacturer's program of reimbursement. This Plan is not intended to create or limit any implied warranties concerning your DSL device, which may or may not exist under applicable law.
The Service Shield is a required component of having the StratoNet DSL Service, StratoNet may in its sole discretion, terminate or modify this agreement at any time.
